Contracts and Real Estate

A real estate transaction is often the biggest transaction of a lifetime, and a good contract is the difference between peace of mind and unnecessary risk. We accompany every transaction and every contract with a thorough review and attention to the small details.

Legal certainty with every signature

Buying or selling an apartment involves a series of critical checks: the status of the rights at the Land Registry (Tabu) or the Israel Land Authority, liens and attachments, building permits and deviations, real estate taxation aspects and payment planning. A mistake at any of these stages can be costly, and sometimes lead to the loss of the entire transaction.

Alongside real estate, we draft and review commercial and personal contracts: partnership agreements, service agreements, loan agreements and leases. A well-drafted contract prevents the next dispute, before it arises.

How to support a real estate transaction properly

Preliminary checks

Land Registry (Tabu) extract, liens, permits and the building file, before committing to anything.

Negotiation and drafting

Forming commercial terms, security and a payment schedule, and drafting a precise agreement.

Signing and reporting

Signing, registering a caveat (warning note) and reporting to the Israel Tax Authority within the time set by law.

Completion and registration

Transferring the rights into your name at the Land Registry (Tabu), and closing the transaction safely.

Questions worth asking

Why do I need a separate lawyer and not the other party's lawyer?

The other party's lawyer is committed to their client's interests, not yours. In a transaction worth hundreds of thousands or millions of shekels, independent representation that reviews the transaction from your point of view is a necessity, not a luxury.

What is a caveat (warning note) and why is it critical?

A caveat is registered in the land registers and prevents the seller from making a conflicting transaction or encumbering the property after signing. Registering it immediately after signing the agreement is one of the most important protections for the buyer.

Buying an apartment from a developer: what should I pay attention to?

To security under the Sale (Apartments) Law: a bank guarantee or an insurance policy for every payment; reviewing the technical specification; delivery dates and compensation for delay; and the repair clauses during the inspection period. Developer agreements are complex agreements that tend to favor the developer, and there is room to improve them.

When should a lawyer review a contract?

Before signing, always. The cost of reviewing a contract is negligible compared to the cost of litigating over a bad contract. A good contract anticipates points of friction and sets clear mechanisms for resolving them.
